erb line with "% ..." as the first line in a template isn't evaluated

I noticed that if I start a file with a "%" line (with erb_trim_mode = '%-') it doesn't get evaluated. It does however if I put an empty line before it.

Example:

% if xyz
<!-- ... -->
% end

(raises because of unexpected 'end')

<!-- this line can be empty but has to be there -->
% if xyz
<!-- ... -->
% end

(works)

% xyz = 'abc'
<%= xyz %>

(raises because of undefined method / variable 'xyz')

This only happened with version 2.3.5, with 2.1.0 it used to work. Ruby version is 1.8.7p160
