I think using 0.9.7 is fine - the difference between 0.9.6 and 0.9.7 was just an emergency fix for RSpec.

Swallowing exceptions is nasty. The patch looks good. +1 from me.

Hopefully this commit [1] resolves the Mocha aspects of this problem. Let me know if not.
